CURRENT CONTRACTUAL TERM:
The (delivery) dates agreed upon are subject to the condition that there are no delays due to the crisis in connection with the novel coronavirus (SARS-CoV-2/Covid-19; e.g. as a result of any necessary interruption to production at PLASTOCELL and/or any missing, delayed, incomplete or incorrect delivery by suppliers). PLASTOCELL will use its best efforts to avoid any such delays. Should such delays nevertheless occur, the Parties shall reach a fair agreement with respect to the further procedure and the (delivery) dates possible in the particular case. Any claims for damages or other payment claims against PLASTOCELL in connection with any delays due to the aforesaid coronavirus crisis and which are not attributable to PLASTOCELL shall be excluded.
